Conditions for Entry

OVERVIEW
Happy Cakery Pty Ltd ABN 68 630 855 686 / Runaway Cupcakes is committed to creating and maintaining a safe environment for all attendees at our stuio. This includes following all applicable laws, creating and developing procedures and policies to objectively identify, manage and minimise risks and encourage an attitude of shared responsibility for compliance.
We have developed these Conditions of Entry to outline the responsibilities of each member of our community which, along with our Terms and Conditions and Privacy Policy govern all class guest, staff and visitors.
By registering for and attending any Event, you acknowledge that you have read, understood, agree to be bound by and have had an opportunity to seek clarification on any aspects of these Terms.
If you do not agree with any of these Terms, please reconsider registering to attend any Event or if you have any questions, please contact us at order@runawaycupcakes.com.au
BEHAVIOUR
All guests agree to display, promote, and encourage safe and respectful behavior to fellow guests, Staff, Third Party Entertainment and visitors.
This includes:
- Being polite, kind, and courteous to others;
- Using inclusive, respectful language;
- Respect the privacy of others;
- Respecting the personal space of others;
- Respecting the property Runaway Cupcakes;
- Listening to instructions provided by Staff and instructor and not hinder the experience for others; and
- Arriving at least 5 minutes prior to the start time of your session.
- To minimize conflict, please do no engage to any political conversation.
Any guest using rude, offensive, obscene, threatening, or profane language, nudity, touching or making inappropriate physical gestures, prior to or during a studio session will be refused entry to, or asked to leave Runaway Cupcakes as determined at the sole discretion of Runaway Cupcakes staff and instructor.
We agree to display, promote, and encourage a safe and respectful behavior to fellow guests, Staff, Third Party Entertainment and visitors including:
- Being polite, kind, and courteous to others;
- Using inclusive, respectful language;
- Respect the privacy of others;
- wear a uniform and/or a name badge so they are clearly identifiable;
- provide guidance that is fair, respectful, and appropriate; and
- monitor responsible consumption of alcohol.
PHOTOGRAPHY OF CLASSES
Runaway Cupcakes Staff
Our Staff may, for the purpose of social media content, internal training and quality control measures, record portions or whole private or public classes or events.
Our Staff will notify guests at the beginning of a class if recording is taking place, whereby the guest may opt out of being filmed. Photos or recordings of classes may be published or used in promotional material by the Pinot & Picasso Studio or Pinot & Picasso Head Office.
Consent may be withdrawn at anytime and whilst Runaway Cupcakes will retain the ownership of this media, any request from a guest to remove their images will be done so as soon as reasonably practical (but by no later than 2 business days from the date of the request).
We ask that any requests for removal of photos be sent via email to order@runawaycupcakes.com.au with the subject line ‘urgent photo removal request’.
No images are to be captured of minors, unless permission is granted by the parent or guardian.
Runaway Cupcakes Guests
Guests are permitted to take photos or videos during their classes where they agree that:
- photographs/videos only feature them / their group only;
- photographs/videos should not be taken if disruptive to the class;
- Staff and Models should be asked if they consent to be included in photos and have the right not to be photographed/filmed if they request; and
- Filming of large portions or entire classes are not permitted;
We encourage any one to raise any issues or concerns with Runaway Cupcakes on site in relation to any breaches of privacy.
Happy Cakery Pty Ltd/Runaway Cupcakes reserves the right to inspect, stop or delete any images/video material if we suspect inappropriate photography and escalate the matter to appropriate authorities if necessary.
Inappropriate photography or videos taken by a guest will result in immediate ejection from the class.

Kids/Minor Party and Classes
Runaway Cupcakes staff are police checked and hold work with Children Check. Brief interview will be conducted to determain:
- Attendee is able to sit through most of the class with attention on project on hand
- Attendee is passionate about crafting and willingness to learn
- Attendee will be friendly to others and staff
Parents of student will ensure that the student attending the class will
- Respect others,
- not to use any offensive language,
- no inappropreate physical contact
- strickly no photograph of others
- not to disturb class and others
Runaway Cupcakes staff and instructor will make best effort to ensure the safty of our class/party enviornment. Ensure a positive experience for all party goers and class students. That is why we do no tolorate any miss behavior in our space. Parents will be notified immediately of any dangerous miss behaviour and are to collect the student/attendee immediately.
Use of sharp and pointy tools
Sharp and potentially dangerous tools may be present onsite as we are a crafting studio. We will do our best effort to minimize the use of sharp object, we will use non sharp object for example: plastic knife, pallet knife(non sharp edge) or helping them if sharp object is nessasary. Our staff are first aid trained and we have simple medical kit onsite. Insidents will be recorded and notifed immediately through photo/messages.
ENVIRONMENT
Surveillance
For the safety and security of guests and staff, please note recorded video surveillance and silent alarms may be in use.
Cleaning
Studios and equipment will be regularly cleaned and/or sanitised between classes (as applicable). Please notify our Runaway Cupcakes Staff if you see anything that requires our attention.
What to wear
Due to the nature of the activity, we ask that all guests wear comfortable, appropriate clothing for the events. We appreciate clothing not featuring any profanity or insensitive slogans or statements. Whilst we provide protective aprons, Runaway Cupcakes does not accept responsibility for any losses or damages incurred to clothing or personal items.
What to bring (or not to bring!)
We ask that guests bring minimal if any accessories to their classes, due to limited space within the studios. We are unable to provide lockable space for your valuables Runaway Cupcakes does not accept responsibility for any losses or damages incurred to clothing or personal items.
Smoking (including e cigarettes / vaping)
Runaway Cupcakes studios are strictly smoke-free (including e-cigarettes or vaping) and smoking is not permitted under any circumstances.
Catering & Allergies
Runaway Cupcakes uses local supplier and therefore, inclusions in our Grazing Boxes vary across our studios. Our Grazing Boxes include food that contains or may contain: peanuts, tree nuts, milk, eggs, sesame seeds, fish, shellfish, soy, lupin, wheat.
Please detail any dietary requirements, food intolerances or allergies you are affected by during the event booking process or prior to the event to allow us to take them into account when organising food with relevant vendors.
Whilst we will make every effort to cater to your dietary requirements, accommodate any allergies or intolerances and impose reasonable steps to avoid contamination between food products, we cannot guarantee that the food provided will be free of allergens. If you require medical attention at any time during the Event, you acknowledge that we will share the relevant information provided by you on your Booking Registration with emergency response or paramedic personnel. You will be solely responsible for any costs associated with said treatment. We recommend that you maintain appropriate insurance for your participation in any Event.
You understand and accept that you consume the food provided at your own risk and that we shall not be liable for any allergic reactions or health issues that may arise as a result of consuming the food.
EMERGENCY
In the event of an emergency, please follow all directions of our Staff. We encourage you to familiarise yourself with our Emergency Exits (which are clearly labeled and free of obstruction) should an evacuation be required.
ALCOHOL
Unless otherwise advertised, our events are for over 18 guests. Whilst a liquor licence is not required to operate a BYO venue (Liquor Act 2007), Runaway Cupcakes take precautions to operate responsibly in our studios such as:
- refusing entry to intoxicated guests;
- providing drinking water;
- encouraging responsible alcohol consumption to all guests, including asking guests to stop consuming alcohol;
- Ask intoxicated guests to leave the studio;
- Following Responsible Service of Alcohol protocols.
The following beverages are accepted as BYO options;
- Beer;
- Wine;
- Cider;
- Premixed sealed beverages.
The consumption of shots or straight liquor is not permitted in Runaway Cupcakes Studios. This includes bringing in separate products to mix in-studio.
It is illegal for any person to supply liquor to a minor or permit a minor to drink liquor in a BYO venue. Pinot & Picasso prohibit underage drinking and will be entitled to refuse entry to or eject any guests who contravene this provision. Fines and or other penalties may also apply to the individuals and to the venue as governed by applicable laws and local authorities.
OUR RIGHTS
Happy Cakery Pty Ltd/Runaway Cupcakes reserve the right to:
Refuse guests’ entry to the premises on a temporary or permanent basis.
Request guests leave the premises without a refund, should they breach any of these Conditions of Entry.
